I wrote earlier in the week about my daughters' injury on the playground at school.
Well as usually happens in small towns more information has gotten out. Apparently the piece of equipment my daughter was on was broken and the bar she reached for collapsed as she put her weight on it.

We noticed that the equipment was taped off yesterday. Then last night while i was in town a friend of mine told me that one of the other kids in my daughter's class told her Mom what REALLY happened to my daughter. She leaned on the bar and it collapsed.
The friend I spoke to last night said that her daughter told her there were some "construction men" fixing that piece of equipment yesterday. So I had my wife go to school this AM with the camera to take photos of any new bolts or welds, etc....... and there were two brand new shiny bolts. Photos were taken.

I called the Principal and gave her a chance to come clean and she did NOT.

Then just this AM we found out that another little boy has recently broken his arm on the playground. that's four kids with bad injuries in a year.

I contacted a lawyer a short time ago to get some legal advice. My concerns are:

1) Most importantly, making that playground much safer IMMEDIATELY.
2) Medical bills that my insurance will not cover. At this point that looks like it could be substantial since my hospitalization insurance covers only 90% with me paying the other 10% out of pocket.
3) My daughter's long term health of that elbow that is broken. She may need a second surgery and the surgeon readily said that there could be long term effects from the injury.

So anyway I searched long and hard for a lawyer in my area with a good ethical reputation. Someone that grew up in the area and has strong ties to the community. I'm not looking to get rich off of this. I want the problems at the school fixed and my daughter taken care of. Also no reprisals toward my kids from the school system.

Seriously, it sounds like you have a solid case for neglience & damages.

Seriously, it sounds like you have a solid case for neglience & damages.
Hope your daughter is feeling better.

I really have mixed feelings about getting a lawyer involved. I even told the secretary that. She was appalled by the things I told her about what has happened to my daughter and the other kids.
I told her that something needs to be done immediately to fix the unsafe playground situation. Trying to be the nice Mommy and Daddy hasn't worked. I'm hoping I can get some good advice from this gentlemen. His firm has a very good reputation in the area.

Good luck Mike. And I hope your little one makes a speedy recovery. Having a daughter, I know how it feels when something happens to them. Sorry I didnt hear about this earlier with being away on holiday, but you guys are in my prayers now.

Give our best to your daughter.

Now as for the lawyer,, do what you have to do. The kids need to be protected from dangerous equipment, and your daughter needs to be taken care of to the fullest extent.

i hope your daughter is doing well.  As for the lawyer, you have to do it.  It's the only way for them to know you not just kidding around.  What's it going to take, a kid to fall and break their neck.  By then it would be too late.

Glad your daughter is on the mend.  Caution though, a lot is going to depend on whether the school/school district has liability insurance and the status of sovereign immunity in your state.

my stepdads an attorney who deals with these EXACT situations. its too bad you dont live in ohio. i could easily hook you up. hes a great attorney and highly trusted. but anyways....i hope you find a good attorney. this situation is BS and schools are lazy as hell. they need a wake up call. do whatever it takes to get justice.

the only negative that could come from this if you win is how the schools going to treat your kids. they could hold a grudge against your family and take it out on your kids by making their life hell.watch for that.

but hey...what do  know im only a 20 yr old kid myself lol.

Where I'm from my mother's side of the family is well known for raising hell and taking care of their own. But since I had my fathers surname there weren't many problems, but I had a vice principal nearly break my arm in grade 3 and a math teacher failed me 3 times in high school just because they hated my family.

Once word got out things were taken care of... we don't tolerate too much BS down home ;)
