Suggest you ask him to move out and into a motel/hotel and meet the date. Can you determine if he's using your contract to purchase to close the other deal? That may give you a leg up?

He's already made it clear that he's unwilling to move into temporary housing. He is using my contract to purchase a house, which is good. But, if he doesn't get the mortgage and isn't willing to move into temporary housing, we're all done with him.
Tommorrow (9/12) is his deadline to have mortgage comittment for the house he's buying. I was told they were hoping to have that today but I've not heard anything.
This guy has had 3 other deals fall apart, in selling his house, and I know why now ...

Are you using a real estate agent? If so, they might be able to ask their agency lawyer to look at your contract for "specific performance" or damages based upon the amount of the deposit.

The Latest Rollercoaster:
Our closing (the latest) to buy our house was to be 9/19. Yesterday I received good news that the closing was scheduled and all set. We celebrated (given that the hotel has grown very old). Then last night I received an email about how the seller is having trouble securing his mortgage for the house he's buying. This morning I find out that the seller is definitely not closing on his house 9/19 and they don't know when or if he will close (credit problems). The seller ruled out any temporary housing, earlier, so I thought this deal was done.
My lawyer was unable to get in touch with his lawyer (in a hearing), so at 4:00 I said screw it and call the seller directly leaving a message that laid it on the line - "DO YOU INTEND TO SELL YOUR HOUSE TO ME ON FRIDAY OR NOT". He called back 5 minutes later and said YES, and said they would move into a hotel. Welcome to my world ....
So, it seems like it's going to happen on Friday, although I'll believe it when it happens. Cross your fingers for me guys ....

We moved out of our house today and are selling tomorrow. We moved into the Residence Inn and it's ok, I guess. We have a 1 bedroom suite but it's really small. After going through 5 weeks of packing it was nice to relax in the pool and hot tub.
We just really want to buy the house we have a deposit on, but the deal is shakier than ever. The flakey owner won't leave until he finds a house to buy and he's rejected all 30+ houses he's looked at. If we don't get some enouraging feedback from him within the next few days, we're going to start making appointments to look at others houses ....

This morning it was OFF ... and then back ON again in the afternoon. Flakey ...
The guy selling me his house moved into the same hotel today. His kids were swimming in the pool while he moved out of the house this evening. Tonight and tomorrow night both our families are sleeping in the same hotel, while the house we've been fighting over is vacant. Because he's been such an a$$hole throughout this, it will be a little awkward crossing paths with him in the hotel.
We're closing tomorrow and the movers are coming Saturday. We're excited ...
